killing a couple in menlo park is supposed to be in court this morning. the court date keeps being pushed back due to medical issues. her blood alcohol level was apparently twice the legal limit in the october 24th crash. here's elizabeth with traffic. >> and right now tow crews are working to clear a couple of cars approaching pinole valley road. the accident is causing a few delays. one lane is blocked. the back-ups extend looks like into hercules maybe for a couple of exits. here is a live look past the accident scene. everything is moving okay through berkeley. highway 4 looks like this. pretty typical staff off the -- stuff off the anitoch bridge. things improve towards pittsburgh bay point. a quick check at the bay bridge toll plaza. looks like they just switched on the metering lights.

70s in some spots. inland about 70 in livermore and pleasanton. 68 degrees in concord and 68 degrees if san francisco. that's a look at the forecast. guys, back to you. >> thank you, lawrence. kpix 5's cake owe guerin has more on that incident the a lax last friday. >> frank, as soon as the incident at lax happened on friday security officials at sfo put their own plan in place. it's those security officials that are asking all people to be more aware of their surroundings. >> a law enforcement official tells the "associated press" shooting-suspect paul ciancia is heavily sedated as armed guards keep watch over him. police charged the 23-year-old in friday's deadly shooting at los angeles international airport. officers shot ciancia four times to end the shooting rampage. but before the suspect was taken to the hospital an official says he told them he acted alone. >> he had the gun down like

this. >> reporter: passenger scott screen witnessed the shooting. he was among the more than 100 people who ran for their lives. >> doesn't make sense to me. i thought, you know, well, that guy had a gun and no one was there to stop him. >> reporter: court papers reveal ciancia left a letter saying he made a conscious decision to try to kill. investigators say he targeted tsa acts. transportatio security administration officer 39-year-old gerardo hernandez was killed. two other tsa employees and a passenger were wounded. ciancia does not have a history of mental illness, but we know he texted his family recently saying that he was very unhappy to the point where his father asked lapd officers to check on his son last friday. but by the time officers got to ciancia's apartment he had already left for lax. reporting live at sfo, cate caugiiran. a threat disrupted flights in alabama and prompted a two

hour evacuation. an employee at birmingham-shuttlesworth airport found a threatening note in a restroom yesterday. the bomb squad found nothing dangerous. new this morning a person in a wheelchair is killed in a hayes valley neighbor the of san francisco. it happened about midnight at the intersection of market street and octavia boulevard. and happening today, the family of 13-year-old andy lopez plans to file a federal suit against sonoma county and the sheriff's deputy mo shot and killed the teen. the family has already filed three wrongful death claims in the case. deputy eric gel house shot and killed lopez last month. the boy was carrying a pellet gun that looked like a real assault rifle. spike in campus price has police at uc berkeley stepping up efforts to keep students safe and their belongings protected. kpix 5's brian webb tells us how students are now taking their own precautions. >> reporter: crime on berkeley's campus is up this year.

way up. and students are talking. >> you automatics see like a new store -- always see like a new story every day. like somebody is getting robbed. >> i heard people have gotten mugged on campus more than usual and i hear there has been a few cases. >> reporter: the student newspaper shows technology is the target from iphones to laptops, and students walking by themselves are often the victims. >> i think for women and especially at nighttime crime is really bad. >> reporter: campus police are taking notice, starting new nighttime patrols in high-crime areas, and students admit they feel safer on campus than off. >> once you get a little bit farther out from campus it gets a little bit bad. >> reporter: and most students say they have learned the best way to stay safe is to be smart. >> students should try to either walk with somebody or if they feel unsafe call for a walk. i think the university has systems set up so that will be okay. >> they have made a request to campus leaders and police to

address the crime issue and come up with ways to stop it. meanwhile, the bart board of directors will soon vote on a contract approved by the unions to finalize their deal. but at least one member of that board haven't very happy about it. the deal includes a 15% pay raise over the next four years. the workers must pay into their pensions and monthly healthcare contributions as well. the zachary mallett thinks bart gave in it too easily. >> we betrayed the public. the public adamantly, a super majority stood behind us. we accepted the strike even though the unions are who called it, yet we weren't really to accept it. we sweetened the deal once the strike happened. >> he says he will vote no on the contract. the meeting to vote on the contract should happen in the next few weeks. big changes are in the works for a major east bay shopping center. plans for expansion could push 100 businesses out. broadway plaza and walnut creek is planning to add 300,000

square feet of retail space. the project still has to get the city council's approval next month. the expansion will mean about 100 stores currently in the plaza have to close by the end of january to make room for construction. shoppers say they're ready for the expansion about new s with new -- with new high-end stores. >> the variety of shops that are offered, the outdoor feel. >> neiman marcus, nordstrom, macy's. yes, all of the above. >> some stores, including victoria's secret, have already moved out of the construction zone. this is day three of the dung news crab season along the central and northern california coastline and it looks promising. the commercial season starts november 15, but sports fishermen able to start crabbing 12:01 in the morning saturday. this year for the first time in california regulators eliminating the number of traps commercial trappers can have. and a 105 sunken tugboat will be raised from the estuary

this afternoon. it has been sitting out there for decades now. epa says it poses hads arz to recreational sailors and releases contaminants into the environment. this is one of two vessels being removed during the clean-up effort. new video from egypt where protesters gathered outside a courthouse today as ousted islamic president mohammed morsi faced charges. shortly after the trial began, it was adjourned until january. a defiant morsi insisted to the court he is still egypt's legitimate president and he rejected the legal proceedings against him. he is accused of inciting violence and murder. for four days the world watched helplessly as terrorists carried out a siege on a shopping mall. by the time it was over 67 people were dead. the suspects today are appearing in court in connection with the attack. a somali terrorist group has claimed responsibility. a student trapped for days wedged between a dorm and a

go up for welcome back. ebay is apologizing for allowing a batch of apparent items from the nazi holocaust to go up for bid. some items included a suitcase and a star of david arm band. ebay has removed the items and donated the money to a suitable charity. holocaust memorabilia is trending now. also trending two kenyans won the marathon titles in new york. and mars launch. and toronto mayor, mayor rob ford, is apologizing for being drunk in public and promising to make changes in his life. and airport alligator. >> a pa gers pointed out that -- a passenger pointed out that there was an alligator up under here. i was like, what? >> for sure. on friday workers at chicago's o'hare airport caught the baby

the scene now -- heading to the scene now. meantime, it looks like we are starting to see some tee lace. all those headlights, that's the westbound traffic. as you saw from the drive time, it's almost a half hour now on westbound 580. here is a life look at the bay bridge. the sun is starting to come up and 22 minutes or so from westbound 80 to the mayes. the mayes are stacking up towards the west grand overcrossing. a good ten, 15 minutes or so to get you on to the bay bridge. if you are a south bay commuter everything is looking good coming up 101, 280 and the guadalupe parkway. mass transit systemwide bart also reporting no delay. golden gate ferries, caltrain and ace train one and three, everything on schedule. speaking of south side, let's get another check of the one he one near the mckee exit the delays are beginning to build. it's the time of the morning we start to see a few brake lights

past san jose and are towards santa clara. that is your latest cbs traffic. lawrence has been fidget being the air conditioner button or i think it's cold outside? >> i think it's just cold outside. frank wouldn't do that, would he? fog around the bay area, yeah, chilly to start the morning. but it is clear all the way to the coastline. what a beautiful beginning to the day. ocean beach nice clear skies. cool towards the coastline today, but still nice and sunny all around the bay area. looks like some of those temperatures this afternoon right around seasonal. that means comfortable. likely will see some low 70s inland and warmer weather as we head too to the middle of the week. then things may shift towards a wetter pattern towards the weekend. high pressure in control right now. starting to rebuild into the bay area after a few clouds floated by yesterday with a weak weather system. still looks like more sunshine,

maybe some occasional high clouds the next few days. really some pod exist warming over the next few. flying out of sfo looks like a clear start. no delays expected there. about 66 degrees this afternoon. around the country a couple of trouble spots. into denver expecting showers there, about 50 degrees. showers also into houston at 73. sunny and dry but very cool in new york. a high of only 46 degrees this afternoon. around the bay today you will see sunshine. 67 degrees in san jose. 67 in sunnyvale and 61 degrees and cool in half moon bay. and some low 70s inside the bay. plenty of sunshine. 68 in san francisco and 69 in oakland. 70 degrees in kemp field. next couple of days we will watch the temperatures warm up a few degrees. this next weekend a few more clouds coming our way. we might start to talk about some rain. we will see what happens. >> you had a like that, wouldn't you? >> i would love it.

it's an idea being pushed by major league baseball? >> reporter: that's right. the mlb is really turning up the heat on these negotiations. so if the a's and the coliseum don't come to some sort of agreement on a new short-term lease, the a's can leave oakland entirely and take up a new temporary two-year home right here at at&t park. sources close to the negotiations told the "san francisco chronicle" major league baseball is making its demands known to coliseum officials. the mlb wants a shorter two- year lease extension for the a's. not the five to eight-year deal the coliseum put on the table. a shorter lease would give the a's an opening to move to san jose if those legal hurdles can be cleared. and if that short-term lease is denied, sources say the a's could cut the cord with the coliseum entirely moving to at&t park and sharing space with their rival giants as early as

next season. the terms of the lietz are getting a-- lease are getting attention. but the bigger hurdle, according to the chron canle, is the concession stands. the old lease has the a's making big money off food and drink, and now the coliseum wants a bigger piece of the pie. back and forth on that topic has dragged on for two years now. but with the mlb stepping in and putting pressure on for a deal, a compromise could be near. so why would the giants ever agree to allow a rival on their turf? well, one reason, the rent money they could generate from the a's being here at at&t park. there is no doubt this would be difficult. already next season the a's and the giants both have home games on nine of the exact same dates. live at at&t park, mark kelly, kpix 5. >> that makes it difficult. "the chronicle" reports the raiders will get a new lease at the coliseum, but that deal is year to year. some new details this

morning about the man suspected of gunning down a tsa officer inside lax. investigators say this man, paul ciancia, accomplished two goals mentioned in a suicide note. >> the suicide note the that i read talks a lot about killing tsa agents. he said if i just kill one, my pigs is accomplished -- my mission is accomplished. >> he wanted to instill fear by showing how easy toss to get a gun inside an airport. he killed a tsa agent. he was shot four times by the airport police. ciancia now heavily sedated under the watched of an armed guard at a southern california hospital. the white house is launching a new effort to repair the image of the affordable care act. this week president obama will visit volunteers in dallas who are trying to sign up people for the health insurance. the healthcare.gov website repeatedly crashed into the first month and was even down for repairs this weekend. republicans are increasing calls

now to delay change or end the health care reform plan. >> they are trying to change a tire on a car going 75 miles per hour down the expressway. >> the white house says by the middle of the month it will release numbers showing how many people signed up for health coverage during the first month of the enrollment period. officials say the numbers will be lower than what they had hoped for. president obama is returning to the bay area at the end of this month. he is scheduled to appear november 25th at the san francisco jazz center. it's a fundraiser for two committees to help democratic candidates in house and senate races. it will be the president's first fundraising spring since june. a san francisco park is about to get a major makeover. construction is set to begin at dolores park in january. the multi-million dollar project includes two new restroom buildings, two dog play areas, a multi-use court and a central path. the northern half of the park will close six months during

into san francisco. unusual delays. so coming through the nimitz freeway southbound there were a couple of earlier accidents. everything is now clear to the right-hand shoulder but it's stacking up towards highway 92 towards the exit for the san mateo bridge and beginning to back up through the caster valley wide. and a quick check of westbound 580 for the altamonte pass. very busy. that crash at santa rita is still there. back to you. dead starfish are washing up on beaches on the pacific coast. it causes them to lose their arms and disintegrate. the disease has has killed up to 95% of the starfish in some tide pool populations. 123450 time now is 6:36. twitter makes the wall street debut this week.

go to kpix.com/schoolcast. >> thanks. well, new this morning blackberry says no sale. >> and it's changing bosses as well. here now is finance reporter jason brooks on a monday. >> reporter: good morning. a big change at blackberry. they were hoping to make a deal for $4.7 billion. but that fell apart. instead the struggling smartphone maker is going to raise $1 billion of institutional investors to keep the business going. as a result of this thor is ston heins is stepping down. blackberry is not in the top five or six in shares. investors are not too pleased with this latest report. blackberry shares are falling by about 17% in the early going this morning. twitter just filing with the sec that it's expecting its price range in its upcoming ipo to be in the 23 to $25 range.

that's quite a bit more than the expected range of 17 to $20. that means it could raise between 1.6 and $1.75 billion giving it an valuation right off the bat between 12 and $13 billion. an "associated press" cnbc poll came out and said americans were dubious about putting money in twitter. 36% say it's a good investment. 47% say not so good. we will see what happens when twitter goes pubilc. a decent start this morning. let's look at the numbers. right now the dow up by 35 points. nasdaq is gaining 5. s&p moving higher by 5 points. blackberry shares down 10%. back to you. >> thank you. it is 6:45 now. it is one of the most valuable pieces of real estate in the bay area if not the entire united states and the plan for 8 washington is now triggering a war on the waterfront here in the city. we are talking about this chunk of land in san francisco's waterfront. the plan is to have developers,

a city owned parking lot exchange for new park space along with 134 multi-million dollar condos. but it's not a done deal just yet. voters have to sign off on the plan bypassing prop b and prop c. our survey u.s.a. poll finds prop b failing at the moment. the majority of those polled are against the project that would put condos on the water. same for prop c. no is the majority when it comes to whether the building height limits at 8 washington should be raised. part of the debate is over wealth and access in san francisco's cost of living crisis. the developers have agreed to contribute is $11 million to affordable housing elsewhere in the city. opponents of the plan claim the luxury condos at 8 washington will cost an average of $5 million each. on the other hand, the yes on b side points fingers at an existing private health club. >> i want this waterfront of our city of san francisco to be accessible to everybody.

not just the few and privileged that today we see across the street. it's the private club. >> it completely bothers some people that there is a private club on this property. it's not going anywhere. it's going to be rebuilt. it will be smaller and there wasn't be tennis courts and one pool, but you will have to be to pay to be a member of the facility. >> the plan has been approved by the board of supervisors, the planning department and some other panels as well. people are voting on the waterfront project. election day is tomorrow. >> san francisco examiner columnnist melissa griffin cain joins us. >> reporter: we have 8 washington here in san francisco. but the bay area has the got some its own interesting local measures. in fully 32 cities across the bay area in nine counties voters are going to be deciding on bond measures and sales tax increases. in this graphic you can see the counties in which you may get some sticker shock when you get your property bill or when you go to check out if you are not

careful. be sure to check your ballots if you live in those places. in particular, even bankrupt stockton is asking its res tents d to pay more in sales tax from 8.25 to a 9% sales tax estimate today bring in $28 million a year. however, the most interesting ballot measure goes to sunnyvale. pro-gun control advocates there have put a measure on the ballot that prohibit having magazines on their gun that can hold more than ten rounds of ammunition. this is a huge fight on both sides. this will be the one to watch in the bay area. >> that's here in california. how about outside? are there other interesting things going on election-wise? >> absolutely. in new jersey voters will be decide to go raise minimum wage to $8.25. in new york state voters are going to be deciding whether to allow gambling casinos to be built. a total of seven with four in

upstate new york and three in manhattan. finally, my husband insists that i include this, in harris county, texas, this is the place where the houston astrodome sits, voters are being asked to approve 217 -- excuse me, $217 million in bonds to revamp and redesign the astrodome. if this measure fails, the astrodome is going to be torn down. he wants me to remind you all that this was once called the eighth wonder of the world. so even in little old harris county, texas, there are implications nationwide for football viewers. >> it's very, very old now. >> right. it needs to come in and figure out whether it should go or say. >> the recent government shutdown, has it affected other races? >> it's about to. the congressional races will take place next year. two races right now could reflect how voters are feeling about the shutdown. the first is a governors race in virginia. this is interesting because the

democrats and a tea partier had been running neck-and-neck. now, remember virginia is where a lot of federal employees and contractors live and people who live off of that money live. they are none too happy about this. it will be interesting to to see whether tara mccough live becomes governor based on this new sentiment that has bubbled to the top. also in alabama we have a republican on republican primary in mobile, alabama. i insist my parents live in the area. mobile, alabama. two republicans. one tea party republican who says that he would be the ted cruz of the house of representatives, and bradley burn, a more moderate republican. now, since the shutdown burn has been getting lots of money and endorsements from gop allies like the chamber of commerce. so it will be interesting to see there tomorrow, which their republican primary, what republican voters are thinking. do they want the purity of the

wrong with kubiak but said he did not have a heart attack. birmingham, alabama airport is open once again after being shut down because of a threat. bomb squad technicians searched the facility and police confirmed nothing was found inside. flights were delayed or diverted to other airports during that two-hour shutdown. tsa screeners are wearing black bands on their badges this morning in honor of gerardo hernandez, the tsa officer killed on duty in los angeles on friday. the suspect in the shooting, 23-year-old paul ciancia, is reportedly elling it police he acted alone. he has been charged with murder and committing violence at an international airport. kpix 5's cat he is at the airport this morning. >> reporter: officials are asking, as you mentioned, passengers to be on heightened alert. and we are also learning that security as well is on heightened alert. a law enforcement official tells the "associated press" shooting

suspect paul ciancia is heavily sedated as armed guards keep watch over him. police charged the 23-year-old in friday's deadly shooting at los angeles international airport. officers shot ciancia four times to end the shooting rampage. but before the suspect was taken to the hospital an official says he told them he acted alone. >> he had the gun down like this. but passenger scott green witnessed the shooting. he was among more than 100 people who ran for their lives. >> it didn't make sense to me. i thought, you know, well, that guy had a gun and no one was there to stop him. >> reporter: court papers reveal ciancia left a letter saying he made a conscious decision to try to kill. investigators say he targeted tsa agents. transportatio security administration officer 39-year-old gerardo hernandez was killed. two other tsa employees and a passenger were wounded. and we're learning that ciancia may be eligible for the death penalty if convicted.
